FAQ

While there is some variation from state to state, when a court appoints a guardian, that court may remove the individual's right to: Determine residence. Consent to medical treatment. Make end-of-life decisions. Possess a driver's license. Manage, buy, or sell property. Own or possess a firearm or weapon.

You must file a complete petition for guardianship with the Clerk of the Superior Court. Immediately following filing this petition, you must properly serve the allegedly incompetent adult, otherwise known as the respondent. You may also need to serve the respondent's closest family members.

(1) The guardian of the person is entitled to custody of the person of the guardian's ward and shall make provision for the ward's care, comfort, and maintenance, and shall, as appropriate to the ward's needs, arrange for the ward's training, education, employment, rehabilitation, or habilitation.

Guardianship does not terminate a parent's rights, so sometimes a permanent guardianship that allows visitation with a parent is in a child's best interests. If the circumstances that made the guardianship necessary may change, a temporary guardianship may be more appropriate.

Guardianship can only be established by a court order, so to obtain guardianship over a child or adult, you need to file a petition, even if the parent of a child has already consented to grant guardianship. This process is usually carried out in probate court in the county where the prospective ward resides.

Final Thoughts. In summary, while guardians in California can perform essential roles in the care and protection of a child, they do not replace the parents or acquire full parental rights. Guardians act under the guidance and limitations set by court orders, which define the scope of their responsibilities and powers.

Incompetence is determined in a court proceeding and means an adult is unable to manage his own affairs, or is unable to make important decisions. Anyone may file a written request (a petition) with the clerk of superior court alleging that an adult (the respondent) should be declared incompetent.
