The average processing time for a PERM application is currently around 6-12 months.
It is important to note that the NPWC's reported processing times are what the agency considers to be within normal processing times. This means that it is possible for PWDs to be processed and issued sooner. Currently, at Reddy Neumann Brown PC, we are seeing PWDs being issued in about 6 to 7 months on average.
Using this information, the DOL will provide the employer with a prevailing wage determination (PWD), or a statement of the wage that is based on the specific job along with its particular location. The purpose of the PWD is to prevent employers from underpaying foreign workers to the detriment of US workers.
Currently at Reddy Neumann Brown PC, we are seeing PWDs being issued in about 5-6 months. The DOL is processing PERM applications filed in June 2023. On average, the DOL is adjudicating PERM applications in approximately 388 days, which is up from 387 days as reported in June.
If selected for audit, the processing time for the PERM application could be as long as 16 months or more. This timeframe is consistent with the average processing times being reported by the Department of Labor. We do not anticipate PERM processing times improving in the near future.
For reconsideration requests filed with the Certifying Officer, DOL is currently processing requests filed in April 2024. Currently at Reddy Neumann Brown PC, we are seeing PERM applications approved in about 13 to 14 months on average.
This often requires the claiming party to give a particular notice, sometimes followed by a further notice and/or more detailed information, to the other party and/or contract administrator, which may have to be in a particular format and meet specific requirements as to content.
