FAQ

Founded by the insurance industry in 1943, Arbitration Forums (AF) is a membership-driven, not-for-profit organization that exists to effectively and efficiently serve its over 5,100 members' recovery and resolution needs. AF is the nation's largest arbitration and subrogation services provider.

In a legal context, a forum refers to the location or venue where legal proceedings, such as a trial, hearing, or arbitration, take place.

Decisions are final and binding to all parties, however, any party may appeal a decision wherein the Total Settlement amount is $100,000 or more (Rule 2-12). This appeal must be brought to AF's attention within 30 days from the date of the publication of the decision.

If arbitration is not filed within 60 calendar days of the dismissal/discontinuance, the expiration of the statute of limitations may be asserted as an affirmative defense/exclusion.

Arbitration Forums, Inc. is a not-for-profit organization that handles disputes amongst its nearly five thousand members. These members agree to have specially appointed arbitrators hear their cases in lieu of taking the dispute to a court of law.

Arbitration sessions are open to the public as are most court proceedings. Mediations, however, are private and confidential and are not open to the public. If an arbitration hearing is converted to mediation with the consent of the parties, only the litigants will be allowed to remain in the hearing room.

The purpose of arbitration extends far beyond mere conflict resolution; it embodies a multifaceted approach aimed at fostering efficiency, fairness, and impartiality in the resolution of disputes outside the traditional court system.

The Request for Arbitration may be filed with the JAMS International Administrator in electronic form to international@jamsadr with the requisite number of paper copies sent on the same date by courier service, facsimile or post.
