Non-Breeding Agreement. The Purchaser agrees that the Puppy is being sold as a companion animal (Pet) and not for breeding purposes. The Purchaser agrees to have the Puppy spayed/neutered between the ages of 8 months to 18 months and as recommended or advised by a licensed Veterinarian.
Dog breeders who breed puppies to be sold as pets must be USDA-licensed if they have more than four breeding females and sell puppies wholesale, or sight unseen, to pet stores, brokers and/or online.
Non-papered dogs should not be bred, with very few exceptions (mostly involving outstanding hunting or working ability). Most papered dogs should not be bred either. If a purebred dog is worthy of being bred, it will already have papers, plus a list of titles and other accomplishments appropriate to its breed.
The law (SB 876 signed by Governor Abbot in May of this year) will require anyone that both owns 5 or more intact females and is engaged in the business of breeding those dogs for sale to secure a state license.

This sounds like a tough situation. The fact that there was not a contract signed works against you as much as it works for you.Contracts are a parting-shot opportunity to share their philosophy, advice, and expectations about the dog they are entrusting to you. Fortunately, my breeder did not have me sign such a deal. It depends on the sequence of events, it depends on how you came to find this breeder and what, if anything, the breeder's website says about breeding rights. Most dogs that successfully complete the 120-day program qualify to be dual-purpose dogs that either patrol and sniff out explosives or patrol and detect drugs. I bought 2 pups from out of state and didn't sign any contracts. (b) No person shall engage in the business of leasing or renting a dog. Honestly, I am very tempted to foster fail with this dog.
