Description

A factor is a person who sells goods for a commission. A factor takes possession of goods of another and usually sells them in his/her own name. A factor differs from a broker in that a broker normally doesn't take possession of the goods. A factor may be a financier who lends money in return for an assignment of accounts receivable (A/R) or other security.

Many times factoring is used when a manufacturing company has a large A/R on the books that would represent the entire profits for the company for the year. That particular A/R might not get paid prior to year end from a client that has no money. That means the manufacturing company will have no profit for the year unless they can figure out a way to collect the A/R.

FAQ

A signer must meet face-to-face with a Notary in order to have their signature notarized. Be sure that any person whose signature needs notarization is available and can attend your appointment with the Notary Public. A Notary cannot notarize a person's signature over the phone or video chat.

Just like wills, there is generally no requirement that a contract be notarized in order to be legally binding. However, if a party who signed a business agreement decides to dispute that agreement in court, a notarized contract can help a great deal.

If you need to visit a Notary during regular business hours, you can usually find notarial services at banks, libraries, and mailbox/photocopy shops. Other businesses with Notaries on-site include: FindaNotary. AAA and UPS Stores.

A Letter of Agreement is still a formal legally binding document, acting exactly like a contract. It will usually be more suitable than a contract if both parties are already on the same page (excuse the pun!). A valid Letter of Agreement is the same as a valid contract.

Many contracts, such as simple sales agreements or employment agreements, do not need to be notarized to be legally binding. The requirement varies based on the contract type and jurisdiction. However, some contracts like real estate transfers or powers of attorney may require notarization by law.

Every notarized letter of authorization must list the names of the requesting parties and the reason for authorization. The document must also contain the signatures of each party as well as the notary public's signature to confirm that they witnessed and verified the signatures.

Can you write a letter and have it notarized? Yes, you can fill out the details of a letter on your own and then contact a public notary to get it notarized. If you're wondering what documents need to be notarized, understand that there is a long list of documents you can notarize in your state.

For a notarial act to be valid, the notary must perform the verbal part of the acknowledgment notarial act by asking the signer: “Do you acknowledge that you signed this document voluntarily and for the purposes stated therein?”

Make sure you have the original, complete document that needs notarization. Photocopies or incomplete documents may not be accepted. Valid identification. Most notaries will require you to present government-issued photo identification, such as a driver's license, passport, or state ID card.

To make a notarized letter, begin with your contact details, create a clear message explaining the purpose of the letter. Include any legal language if necessary. Conclude with a formal closing and leave space for your signature. And that's how you write a statement that needs to be notarized.
