An allegation of educational neglect may not be sustained, based solely on a minor's absence from school, unless the minor has been absent from school or from any given class, without good cause, for more than 10 consecutive school days or more than 1/10 of the applicable school term.

These attendance requirements apply to public and private schools, although some states make exceptions for children who are home schooled. Utah requires children between the ages of six and eighteen to attend school, and parents whose children are absent too often may face misdemeanor criminal charges.

Educational neglect is defined by Utah Code. (2018) 78A-6-105 as “after receiving a notice of compulsory education violation under Section. 53G-6-202, the parent or guardian fails to make a good faith effort to ensure that the child. receives an appropriate education” (para. 18).

(1) The General Core and Core Standards for students in grades 9-12 are described in this section. (2) A student in grades 9-12 shall earn a minimum of 24 units of credit through course completion or through competency assessment consistent with Rule R277-705 to graduate.
