Habeas corpus is one of the earliest common law writs. In its simplest form a writ of habeas corpus requires that a person who is in custody be brought before a judge or court and that they be able to challenge that custody. The writ of habeas corpus is used to attack an unlawful detention or illegal imprisonment.
The court must rule on a petition for writ of habeas corpus within 60 days after the petition is filed. (B) If the court fails to rule on the petition within 60 days of its filing, the petitioner may file a notice and request for ruling.
After the Writ of Habeas Corpus is filed, the Court has a few options. The Court may deny the Writ, the Court may request that the government submit a response to the Writ, or the Court may grant the Writ.
State every ground (reason) that supports your claim that you are being held in violation of the Constitution, laws, or treaties of the United States. If an inmate meets all the requirements to file a petition for writ of habeas corpus, they will file their petition in the superior court in the court of conviction. Within 60 days, the court will review the petition to determine if the inmate raised a prima facie case entitling them to relief.
The denial of a petition becomes final immediately if the Court of Appeal has not previously issued an alternative writ or order to show cause. (Cal. Rules of Ct., rule 8.264(a)(2)(A).) That means that a petition for review from summary denial of a petition for writ of habeas corpus must be filed within ten days.
Writs of habeas corpus shall be granted in favor of parents, guardians, limited guardians where appropriate, spouses or domestic partners, and next of kin, and to enforce the rights, and for the protection of minors and persons who have been placed under a guardianship under RCW 11.130.
