Habeas corpus ad subjiciendum means “that you have the body to submit to” in Latin. It is also known as the “Great Writ” and is a writ that is directed to someone detaining another person to inquire as to the legality of the detention.
Today, habeas corpus is mainly used as a post-conviction remedy for state or federal prisoners who challenge the legality of the application of federal laws that were used in the judicial proceedings that resulted in their detention.
An application for a Writ of Habeas Corpus is filed when a person seeks relief from unlawful detention or imprisonment. If the application is filed prior to disposition of the case, it is filed in the assigned District Court or County Criminal Court at Law.

Art. 11.05. BY WHOM WRIT MAY BE ISSUED. The court of criminal appeals, the district courts, the county courts, or any judge of those courts may issue the writ of habeas corpus, and it is their duty, on proper application, to issue the writ under the rules prescribed by law.
