Who may file an EEO complaint? A complaint of discrimination may be filed by an applicant for employment or any employee (current or former) or group of employees.
Presentation of Evidence The burden of proof is on you to show the agency is liable for discriminating against you and that you are entitled to certain relief. You will proceed first with presentation of evidence. Evidence may take the form of documents, live witness testimony, photographs, objects, etc.
Aggrieved persons who believe they have been discriminated against must contact an agency EEO counselor prior to filing a formal complaint. The person must initiate counselor contact within 45 days of the matter alleged to be discriminatory.
