42 U.S. Code § 2310 - Repossession of property; powers of Commission | U.S. Code | US Law | LII / Legal Information Institute.
Part 5 of article 9 of the Uniform Commercial Code (the "Code") governs disposition of repossessed goods. Section 9.505(b) enables a creditor to keep the collateral in satisfaction of the debt,2 if the debtor does not object.
A repossession affidavit is a legal statement filed with the Department of Motor Vehicles when you repossess a car from a customer. This document provides details about the repossession such as why and how the vehicle was repossessed. It also informs government authorities that the vehicle has been repossessed.
Wrongful repossession occurs when a creditor or repossession agent unlawfully seizes a vehicle without following the proper legal procedures. This can transpire due to missed payments, but it may also result from procedural errors, violations of state and federal laws, or deceptive practices.
