First, recall the significance of the lis pendens in the mortgage foreclosure case. The lender files a "Lis Pendens" (a pending lawsuit) in court. The "lis pendens" warns all people that title to the property is in litigation. "Lis pendens" is Latin for "suit pending. Instead, the foreclosure purchaser must remove (expunge) the lis pendens before it can initiate the eviction process.
