Description

Use this agreement to:

establish ownership of the property as each other's separate property and not as community property; state each co-owner’s ownership interest in the property;
establish exclusive private living areas and a common area; establish rules governing use of the property; allocate shared financial obligations such as mortgage, property tax, common area maintenance, and utilities; provide for dealing with a defaulting co-owner;
address the death or bankruptcy of a co-owner; provide a process for the sale or lease of a co-owner’s interest in the property; and provide for dispute resolution through mediation and arbitration. Because this agreement allows an owner to sell their property interest, we kept provisions that a married couple may not need such as establishing private living areas and rules governing use of the property. In the event of an owner's sale of their interest in the property, these terms will be important between the buyer and remaining owner.

Certificate of Service: A form filed with a court's clerk's office stating that the opposing party in a lawsuit received copies of papers filed in the case.

In criminal cases, the judgment is final when the motion for new trial is overruled, allocution given, judgment and sentence entered in ance with the jury verdict, and sentence is imposed.

If the defendant then fails to pay, you can file an appropriate action in court to collect your money (see Section IV, Collecting on Your Claim). The defendant should be sure the plaintiff files a ?Dismissal? form if the defendant pays the judgment before the court hears the case.

The Court requires a civil cover sheet (available from the Clerk's Office) and a complaint that includes an original signature and your address. You must also either pay the filing fee or request the Court to allow you to file the case without paying the filing fee.

A judgment may be revived by order of the court within ten years of the entry or last revival. Mo. Sup. Ct.

Satisfaction of Judgment: Once a defendant has paid-off a judgment, this form is used by the person receiving the money or property to let the court know that the judgment has been paid. Do not use this form to satisfy a judgment that contains an ongoing obligation, i.e. child support or maintenance.

For instance, per Rule 74.06(b)(4), a trial court ?may relieve a party or his legal representative from a final judgment or order? [if] the judgment is void.? A judgment is void if the trial court that rendered the judgment lacked jurisdiction to do so.
