8.111 Attempted Murder (18 U.S.C. Sec. 1113) is a federal crime punishable by up to 20 years in prison. It includes any acts or attempts to kill another person with malice aforethought. The offense may be classified as either first degree or second degree attempted murder, depending on the circumstances. First degree attempted murder is a more serious offense, and occurs when a defendant has a premeditated intent to kill, and takes a substantial step towards killing the victim. Second degree attempted murder is still a serious offense, but is less severe than first degree attempted murder. It occurs when a defendant has an intent to kill, but does not take a substantial step towards killing the victim.
