As of July 1, 2004, Georgia's Compulsory School Attendance Law 20-2-690.1 became much stricter in regard to truancy. The new law states that more than five (5) unexcused absences constitute truancy.
Schools will accept excuses for absences from you for the first five days, which means these are excused. After that, you would have to have an excuse from a doctor or other professional to not end up with an unexcused absence.
A truant is defined as a student who has has 4 unexcused absences from school in one month (30 consecutive calendar days) or 10 unexcused absences in one school year. If a student becomes truant, their school is required to have a meeting with the student's parent/ guardian within 10 school days.
(e) Truant any child subject to compulsory attendance who during the school calendar year has more than five days of unexcused absences.
B. At five unexcused absences, each school system will notify the parent/guardian of the absences and consequences for non-attendance. After two reasonable attempts to contact the parent/guardian, written notice shall be sent.
(e) Truant any child subject to compulsory attendance who during the school calendar year has more than five days of unexcused absences.
The law requires all students ages six to 16 to attend school. Missing more than five days without the school excusing them for valid reasons will make your child truant. If your child is charged with truancy, you could face penalties.
1) Excused: Late arrival to school or class as a result of reasons defined herein as excused absences or as a result of events physically out of one's control such as inclement weather, documented transportation delays, health related emergencies, power outage, compliance with the court order, etc.
The school will accept excuses from parents/guardians for five (5) total days of absence each semester and will use the Georgia Board of Education Rules above to determine whether the absence is excused or unexcused.
If a student has more than ten school days of unexcused absences (cumulative) in any semester, the school system will submit a Certificate of Non-Compliance to the Department of Motor Vehicles (DMV) and the student's license will be revoked by the DMV.
