FAQ

In Georgia, a defendant, generally, has 30 days to answer a complaint that is properly served on him. If the 30th day is a day on which the courts are closed, then the last day to answer defaults to the next business day. However, the day of service does not count as a day during the 30 days.

According to O.C.G.A C§§ 9-11-33(a)(2), 9-11-34(b)(2), and 9-11-36(a)(2) respectively, you have thirty days from the date on the Certificate of Service to respond to your spouse's discovery requests.

5.2. Rule 5.2 - Filing Requirements (1) Depositions and other original discovery material shall not be filed with the court unless or until required by the provisions of O.C.G.A. § 9-11-29.1(a) (1) (5).

Responses to Interrogatories A party responding to interrogatories should answer each interrogatory separately and fully, in writing and under oath. In the alternative, a party may object to an interrogatory, stating the reasons for objecting instead answering.

Unless otherwise ordered by the judge or as provided by law, each party opposing a motion shall serve and file a response, reply memorandum, affidavits, or other responsive material not later than 30 days after service of the motion.

A. Georgia State Court discovery period general begins upon filing of a defendant's answer and lasts for six months (although the court has discretion to shorten, extend, or reopen the discovery period).

When you respond to a discovery request, you should make sure to do it within the timeframe listed in the discovery request or in the scheduling order if the judge issued one. In some cases, the judge will hold a court conference to establish a timeframe for discovery, motions, and the trial.

Discovery enables the parties to know before the trial begins what evidence may be presented. It s designed to prevent "trial by ambush," where one side doesn t learn of the other side s evidence or witnesses until the trial, when there s no time to obtain answering evidence.

Your answers to the interrogatories should usually be short, clear, and direct and should answer only the question that is being asked. This is not the time to set out your entire case or defense to the other side. Take the time to make sure your answers are correct and truthful.
