The Vermont Notice of Petition for Immobilization/Forfeiture of Vehicle is an official document issued by the Vermont Department of Motor Vehicles (DMV) that notifies a vehicle owner that the DMV is initiating a process to immobilize or forfeit their vehicle. This notice is issued to the vehicle owner in cases where their vehicle has been identified as having been used for illegal purposes, such as for the transport of illegal drugs, or for the commission of a crime. There are two types of Vermont Notice of Petition for Immobilization/Forfeiture of Vehicle: 1. Notice of Petition for Immobilization: This notice is used when the DMV is seeking to immobilize a vehicle. The notice outlines the reasons why the DMV believes the vehicle should be immobilized, and the vehicle owner is given the opportunity to respond. If the DMV determines that the vehicle should be immobilized, the vehicle will be impounded and the owner will be responsible for towing and storage costs. 2. Notice of Petition for Forfeiture: This notice is used when the DMV is seeking to forfeit a vehicle. The notice outlines the reasons why the DMV believes the vehicle should be forfeited, and the vehicle owner is given the opportunity to respond. If the DMV determines that the vehicle should be forfeited, the vehicle will be sold or destroyed and the owner will not be entitled to any proceeds from the sale. In both cases, the vehicle owner must respond to the Notice of Petition within 30 days in order to contest the immobilization or forfeiture. If the owner fails to respond, the DMV will proceed with the immobilization or forfeiture of the vehicle.
