A Utah Notice of Removal to District Court (Filed in Justice Court) is a document that is filed with a justice court to remove a case from the justice court to a district court. This document is filed when a party believes that the justice court is not the proper forum for hearing the case or has jurisdiction over the case. There are two types of Utah Notice of Removal to District Court (Filed in Justice Court): voluntary removal and permissive removal. Voluntary removal is when the parties to the case agree that the case should be heard by the district court. Permissive removal is when the justice court agrees to transfer the case to the district court based on the facts and circumstances. The Notice of Removal must include the names of the parties involved, the case number, the court in which the case will be filed, and the reasons for the removal.
