Utah Spoliation is a legal term that refers to the intentional destruction, alteration, or concealment of evidence by a party after an injury or incident has occurred. This often occurs when a person or company finds out they are being sued and deliberately hides or destroys evidence in order to avoid liability. There are two types of Utah Spoliation: negligent spoliation and intentional spoliation. Negligent spoliation occurs when a party fails to preserve evidence through negligence or carelessness. Intentional spoliation is when a party deliberately hides or destroys evidence to avoid liability. In either case, the court can award damages and/or impose sanctions on the person or company responsible for spoliation.
