9.43 Forcible or Attempted Rescue of Seized Property (9.43/9.44) refers to the use of force or threat of force to regain or attempt to regain possession of property that was seized by law enforcement. This type of crime can take the form of either a felony or misdemeanor offense, depending on the severity and circumstances of the incident. Felony charges are usually assigned when the property is valued at more than $500 and/or the person attempting to regain possession of the property uses a weapon. Examples of forcible or attempted rescue of seized property include breaking into a facility to recover seized property, threatening a law enforcement officer to regain possession, and using force to take back possession of a vehicle that was seized by police.
