8.136 Subornation of Perjury (18 U.S.C. Sec. 1622) is a federal crime in which a person knowingly and willfully procures or induces another to commit perjury in a judicial proceeding or official investigation. This includes encouraging or attempting to induce a witness to testify falsely, or to conceal or alter any testimony. There are two different types of 8.136 Subornation of Perjury (18 U.S.C. Sec. 1622): first-degree and second-degree. First-degree subornation of perjury requires an overt act to procure or induce perjury in a judicial proceeding or official investigation. Second-degree subornation of perjury requires the defendant to have knowledge of the intended perjury, and to aid, counsel, or procure the witness to commit perjury. Both degrees of subornation of perjury are punishable by up to five years in prison, a fine, or both.
