18 U.S.C. Sec. 1462 — Bringing Obscene Material into the United States — Elements is a federal law that makes it a crime to knowingly import, publish, distribute, or possess with intent to sell or distribute any obscene material. The law applies to any obscene material brought into the United States, regardless of whether it originated in the United States or abroad. The law specifies three elements for the offense: 1) knowingly importing, publishing, distributing, or possessing with intent to sell or distribute; 2) obscene material; and 3) bringing the material into the United States. Obscene materials include any materials that depict sexual conduct in a patently offensive way, and lack serious literary, artistic, political, or scientific value. The law does not apply to materials imported for personal use, or materials imported for noncommercial, educational, scientific, or other similar purposes.
