This form contains interrogatories, or questions, that are used to determine if a speech is protected or not. These interrogatories ask questions such as: what was the purpose of the speech, was the speech likely to cause harm, and was the speech made with good intentions. Depending on the answers given, the court can decide whether certain speech is protected under the First Amendment or not. There are two types of 13.91 Special Verdict Forms: Form A and Form B. Form A is used for cases that involve an individual's right to free speech, and Form B is used for cases involving a corporation's right to free speech.
