Possession of an Unregistered Firearm (26 U.S.C. Sec. 5861) is a federal offense that involves possession of any firearm that is not registered with the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF). This includes both manufactured and homemade firearms. There are three types of unregistered firearm offenses: possession of an unregistered firearm; possession of an unregistered firearm silencer; and possession of an unregistered sawed-off shotgun. All three offenses are punishable by a fine and up to 10 years in prison. Additionally, possession of an unregistered firearm is a felony offense, and can result in a permanent criminal record.
