Tennessee Motion to Preempt Mediation is a motion that is filed in Tennessee courts to preempt the need for court-ordered mediation. It is used in civil cases to provide a quicker route to trial or other proceedings. This motion is often used when both parties are in agreement that mediation is unnecessary or when an agreement has already been reached between the parties outside of mediation. There are two types of Tennessee Motion to Preempt Mediation: 1) Request for Early Hearing and 2) Motion to Preempt Mediation. The Request for Early Hearing requests that the court move the case to a hearing date or other proceedings without the need for mediation. The Motion to Preempt Mediation is a request that the court waive the mediation requirement and proceed directly to the hearing date or other proceedings. In either case, the court will consider the merits of the motion before making a decision.
