The South Carolina Affidavit of Plaintiff (Distraint) is a legal document used to enforce a judgment in the state of South Carolina. The document is typically used when the plaintiff, or creditor, is unable to collect on a debt owed by the defendant or debtor. The affidavit allows the plaintiff to take possession of property, or assets, owned by the debtor and sell the items to satisfy the debt. There are two types of South Carolina Affidavit of Plaintiff (Distraint): Attachment and Garnishment. Attachment involves the seizure of property owned by the debtor or a third party, and then the property is sold in order to pay the debt. Garnishment is the process of collecting a portion of the debtor’s wages or bank account in order to satisfy the debt. In both cases, the debtor is served a summons to appear in court, where the judge will decide if the debt should be paid. If the judge rules in favor of the plaintiff, the property or wages will be seized and sold to satisfy the debt.
