Oregon Child Custody and Parenting Time Judgments from Other States allows for a court in Oregon to recognize and enforce a custody and parenting time judgment that was issued by a court in another state. This type of judgment is called a “foreign judgment.” There are two different types of Oregon Child Custody and Parenting Time Judgments from Other States: 1) a full faith and credit foreign judgment and 2) a comity foreign judgment. A full faith and credit foreign judgment is one that has been issued in another state and is recognized and enforced in all other states in the country. This type of judgment must meet certain legal criteria, including having been issued by a court with jurisdiction, and not being in violation of that state’s laws. A comity foreign judgment is one that has been issued in another state but is not automatically recognized in all other states. This type of judgment must be registered in Oregon in order to be enforced. The court must then decide whether to recognize and enforce the judgment. It must meet certain legal criteria, including having been issued by a court with jurisdiction, and not being in violation of that state’s laws. If the court chooses to recognize and enforce the judgment, it must be done in accordance with Oregon law.
