Oregon Hearing Request Noncompliance occurs when a person fails to comply with the requirements of a hearing request under the Oregon Rules of Civil Procedure. It can be divided into two categories: procedural noncompliance and substantive noncompliance. Procedural noncompliance occurs when a person fails to comply with the procedures and requirements of a hearing request, such as timely filing or properly serving the opposing party. Substantive noncompliance occurs when a person fails to comply with the substantive requirements of a hearing request, such as providing an adequate response to the issues raised or demonstrating sufficient knowledge of the facts or law. In either case, a court may impose sanctions, such as dismissal of the case or striking of pleadings, for noncompliance.
