An Oklahoma Prisoner's Affidavit of Inability to Pay is a legal document used by incarcerated individuals in Oklahoma to declare their inability to pay court-ordered fines and/or fees. This affidavit is used to request a waiver of those fees and can be used to request a release from jail due to financial hardship. There are two types of Oklahoma Prisoner's Affidavit of Inability to Pay: 1) an affidavit of inability to pay while incarcerated and 2) an affidavit of inability to pay upon release. Both affidavits must be completed with accurate information and signed by the incarcerated individual. The affidavit must include the name of the incarcerated individual, the prison or jail in which they are held, the amount of fees they owe, and their inability to pay the fees due to a lack of financial resources. The affidavit must also be notarized. Upon submission, the court will review the affidavit and may grant a waiver of the fees or release the individual from jail.
