A New York Notice of Claim is a legal document that must be filed by anyone wishing to bring a lawsuit against a public entity in the state of New York. The Notice of Claim must be filed within ninety days of the date of the injury, or else a lawsuit may not be able to be brought. The Notice of Claim is a formal document that outlines the facts surrounding the claim, including the date of the incident, the nature of the claim, the amount of damages sought, and any witnesses to the incident. There are two types of New York Notice of Claim: general and special. General Notices of Claim are used when a plaintiff seeks damages from an individual or entity that is a part of the New York State government, such as a state agency, public school, or municipality. Special Notices of Claim are used when a plaintiff seeks damages from state entities such as the Metropolitan Transit Authority, Port Authority of New York and New Jersey, or any other independent public authority.
