New York Request For Preliminary Conference (RPC) is a procedure by which parties in a civil action may attempt to resolve their dispute without going to trial. PCs are available in New York State Supreme Court, Appellate Division, and the Court of Claims. The RPC procedure is available to all civil actions, including divorce, custody, support, and personal injury matters. There are two types of New York Request For Preliminary Conference: Mandatory and Optional. The Mandatory RPC is required by the Court in all civil actions. The Optional RPC is available if both parties agree to participate. During the RPC, parties discuss the issues in their dispute and attempt to reach a resolution. The RPC is conducted by an attorney appointed by the Court, who will act as a mediator. The RPC is confidential and may not be used as evidence in any subsequent trial. If the parties are unable to reach a resolution at the RPC, the case will proceed to trial.
