New Mexico Consent To Proceed Or Refusal To Consent To Proceed Before US Magistrate Judge is an agreement between the parties in a lawsuit that allows the case to proceed in front of a US Magistrate Judge. It is an alternate to the traditional federal court system where the case would be heard by a District Judge. In this agreement, the parties agree to waive their rights to have a jury and agree that the Magistrate Judge will make all decisions in the case. There are two types of New Mexico Consent To Proceed Or Refusal To Consent To Proceed Before US Magistrate Judge: (1) Consent To Proceed Before US Magistrate Judge which allows the case to proceed in front of the Magistrate Judge; and (2) Refusal To Consent To Proceed Before US Magistrate Judge which allows the parties to opt out of the Magistrate Judge system and proceed in front of a District Judge.
