Service may be completed by mail, by a person over the age of 18 who is not a party to the case. The person serving your requests must complete a proof of service form, typically a Proof of Service by First Class Mail (POS-030).

Since the questions are written, the witness may have more time to think and craft answers, rather than providing more candid answers during discovery. There is also no chance for back and forth questioning in an interrogatory, unless a subsequent deposition is scheduled.

In civil procedure, an interrogatory is a list of written questions one party sends to another as part of the discovery process.

The original form interrogatories and signed proof of service should be retained for your records. If the other party does not respond to your requests, you may use these documents to support a motion to have the court compel responses.

(c)Each party may serve on each adverse party no more than 15 interrogatories, including subparts, unless another limit is stipulated by the parties or ordered by the court.

The requests can be sent to a plaintiff after the commencement of the suit or upon any other party with or after the service of the summons and complaint, with a copy to all other parties. The recipient of the interrogatories is to answer within 60 days of receipt.
