New Jersey Waiver of Service of Summons (AO 399) is a document filed by a defendant in a civil case in order to waive their right to receive a summons. This document informs the court that the defendant has been informed of the lawsuit being filed against them and is voluntarily waiving their right to receive a summons. The document must be signed by the defendant or their attorney in order to be valid. There are three types of New Jersey Waiver of Service of Summons (AO 399): Waiver of Service of Summons (AO 399A), Waiver of Service of Summons with Notice and Consent to Jurisdiction (AO 399B), and Waiver of Service of Summons and Agreement to Jurisdiction (AO 399C). AO 399A is used when a defendant wants to waive their right to receive a summons, but does not want to agree to the jurisdiction of the court. AO 399B is used when a defendant is waiving their right to receive a summons and consenting to the jurisdiction of the court. AO 399C is used when a defendant is waiving their right to receive a summons and agreeing to the jurisdiction of the court.
