The Federal Trade Commission's (FTC) Funeral Rule requires all funeral providers to give information to consumers to help them choose the services and products they want for their deceased relative or friend. Funeral providers must give you a general price of products and services when you ask in person about funeral arrangements and you have the right to keep this list. Furthermore, funeral providers must make price information available over the phone upon request. The funeral provider must give you any other information that is reasonably needed to select the funeral provider and funeral items you want, need, and are able to afford.

If the funeral provider charges a fee for buying "cash advance items," this must be disclosed to you in writing. Cash advance items are those goods and services paid for by the funeral provider on your behalf, such as cemetery plots, flowers, obituary notices, and clergy honoraria. You must also be notified if a service fee is added to the price of cash advance items, and if the funeral provider gets a refund, discount or rebate from the supplier of any cash advance item.

You must give the General Price List (GPL) to ANYONE who asks, in person, about funeral goods, funeral services, or the prices of such goods or services.

There are two and possibly three mandatory disclosures that funeral homes must make on the Statement of Funeral Goods and Services Selected.

Selection Room. A room in the funeral home where caskets, urns, outer burial containers and other related items are displayed for individuals or families to select for purchase while planning a funeral or memorial service; also known as a display room.

Under the FTC's Funeral Rule, consumers have the right to get a general price list from a funeral provider when they ask about funeral arrangements. They also have the right to choose the funeral goods and services they want (with some exceptions), and funeral providers must state this right on the general price list.

The third disclosure informs consumers that they may use alternative containers (defined in the revised Rule) for direct cremations. (4) This disclosure must read as follows: If you want to arrange a direct cremation, you can use an alternative container.

You also must comply with the Rule if you sell pre-need contracts on behalf of one or more funeral homes, but do not yourself provide funeral goods and services. In such a case, even though you don't provide the funeral items, you are an agent of a funeral provider and therefore are covered by the Rule.
