A contract between an advertiser and an advertising agency must be definite and certain in its terms, and should, if there is a possibility that any provision in the contract may bring it within the Statute of Frauds, be in writing and signed by both parties. However, an advertising agreement should be flexible and contain provisions allowing the parties to abandon the agreement if they become dissatisfied with one another.
