By making a FOIA request, the requester shall be considered to have agreed to pay all applicable fees up to $25.00 unless a fee waiver has been granted.

The FOIA does not require a request in any specific form. It only requires a ?written request,? which is defined as a ?writing that asks for information, and includes a writing transmitted by facsimile, electronic mail, or other electronic means.? MCL 15.232(i).

Sec. 13. (1) A public body may exempt from disclosure as a public record under this act any of the following: (a) Information of a personal nature if public disclosure of the information would constitute a clearly unwarranted invasion of an individual's privacy.

Any person other than incarcerated felons may request public records in Michigan. A person who asks for access to public records is not required to justify his or her request. A person can use the information any way they please. The Michigan Freedom of Information Act allows 5 days for any response to record requests.

The Public Body must issue a written notice in response to the request for a Public Record within five business days after receiving the request. 26 If the request is for a readily available Public Record, however, the information generally should be provided within the five-business day period.

The fee must not exceed 10 cents per sheet of paper for copies of public records made on 8-1/2- by 11-inch paper or 8-1/2- by 14-inch paper. A public body shall utilize the most economical means available for making copies of public records, including using double-sided printing, if cost saving and available.

MCL 14.32. How long does the public body have to respond to my FOIA request? Upon legal date of receipt of a FOIA request, the public body has five (5) business days to respond. If needed, however, the public body may also send a written notice extending the time to respond by an additional 10 business days.
