Maine 4.18.1029 Access Device or Credit Card Fraud, 18 U.S.C. Sec. 1029(a)(2) is a state law that criminalizes the use of a false or unauthorized access device or credit card with the intent to defraud or obtain property or services. Under this law, it is illegal to use, possess, produce, traffic in, or transfer a false or unauthorized access device or credit card with the intent to defraud or obtain property or services. It is also illegal to use a false or unauthorized access device or credit card to obtain goods, money, services, or any other thing of value. The law applies to all forms of access devices including credit cards, debit cards, charge cards, and prepaid cards. Penalties for violation of this law can include fines, restitution, and imprisonment. There are two types of Maine 4.18.1029 Access Device or Credit Card Fraud, 18 U.S.C. Sec. 1029(a)(2): misdemeanor and felony. Misdemeanor offenses are punishable by up to one year in prison and/or a fine of up to $2,000. Felony offenses are punishable by up to five years in prison and/or a fine of up to $5,000.
