The Maryland Petition for Resignation of Guardian of the Property and Appointment of Substituted or Successor Guardian is a legal document filed in a Maryland court by a current guardian of the property of a minor or incapacitated person. The petition is used to appoint a new guardian of the property to replace the current guardian. The petition must be signed by the current guardian, and it must include the name and address of the proposed successor or substitute guardian, as well as the reasons for the transfer. The petition must also include a list of the assets or property that the proposed guardian will manage on behalf of the minor or incapacitated person. There are two types of Maryland Petitions for Resignation of Guardian of the Property and Appointment of Substituted or Successor Guardian: (1) an Emergency Petition, and (2) a Standard Petition. An Emergency Petition is used when there is an urgent need for a new guardian, such as in the case of a medical emergency or the death of the current guardian. A Standard Petition is used when there is no urgent need for a new guardian.
