The Massachusetts Decree and Order on Petition for Late and Limited Formal Testify and/or Appointment is a legal document used in the state of Massachusetts when an individual has died without leaving a will or without having previously appointed an executor. This document permits the court to appoint a qualified individual to manage the decedent's estate. The Massachusetts Decree and Order can be used for a variety of purposes, including: the appointment of a Personal Representative (Executor or Administrator); the probate of a will; the appointment of an Attorney to represent the estate; the transfer of assets; the release of liens; the filing of tax returns; and the distribution of the decedent's property. There are three types of Massachusetts Decree and Order on Petition for Late and Limited Formal Testify and/or Appointment: 1. Limited Formal Testify: This is used when an individual has died without leaving a will or appointing an executor. 2. Limited Formal Appointment: This is used when an individual has appointed an executor but has not yet drafted a will. 3. Full Formal Testify and/or Appointment: This is used when an individual has both appointed an executor and drafted a will.
