A Massachusetts Complaint for Custody/Support/Parenting Time is a legal document used to initiate a child custody or visitation case in a Massachusetts court. This type of complaint is used to request child support, parenting time (visitation), or the establishment of legal custody. There are three different types of complaint forms available in Massachusetts: Complaint for Custody, Complaint for Support, and Complaint for Parenting Time. In the Complaint for Custody, the plaintiff (the person filing the complaint) must provide information on the parties involved in the case, the child’s date of birth, and the grounds for the Complaint (such as why the plaintiff believes they should have custody). The Complaint for Support must include the same information about the parties, as well as the amount of support requested. The Complaint for Parenting Time must include the same information, as well as the proposed date, time, and place for parenting time. All of these Complaints must be filed with the court and served on the other party (the defendant). Once filed, the court will then set a hearing date to hear the case.
