A Kentucky Statement for a Compensation Claim in Excess of the Statutory Case Compensation Maximum (District Court) is a document used by a party in a civil action to request an award of compensation in excess of the statutory maximum limit. This statement, which is submitted to the court, must include detailed information and supporting documentation to demonstrate that the requested amount of compensation is justified. There are two types of Kentucky Statement for a Compensation Claim in Excess of the Statutory Case Compensation Maximum (District Court): Type A and Type B. Type A Kentucky Statement for a Compensation Claim in Excess of the Statutory Case Compensation Maximum (District Court) is used by plaintiffs seeking damages for personal injury or wrongful death. This type of statement must include a description of the injury/incident, a description of the nature and extent of the damages suffered, and evidence of the defendant's negligence or recklessness. Type B Kentucky Statement for a Compensation Claim in Excess of the Statutory Case Compensation Maximum (District Court) is used by plaintiffs to request an award of punitive damages. This type of statement must include a description of the defendant's conduct or behavior that is the basis for the punitive damages request, as well as evidence of the defendant's malicious and/or egregious conduct.
