The Kentucky Petition-Motion for Removal of Firearm Prohibitions is a legal document filed in the Circuit Court of the county where the petitioner is a resident. This petition seeks the court’s order to remove firearm prohibitions in Kentucky. The petitioner must be a resident of the county for at least 6 months in order to file this petition. There are three types of Kentucky Petition-Motion for Removal of Firearm Prohibitions: (1) Prohibited Purchaser Removal Petition, (2) Prohibited Possessor Removal Petition, and (3) Prohibited Transporter Removal Petition. The Prohibited Purchaser Removal Petition is for individuals who have been found by a court to be a prohibited purchaser of firearms and are now seeking to have that designation removed. The Prohibited Possessor Removal Petition is for individuals who have been found to be a prohibited possessor of firearms and are now seeking to have that designation removed. The Prohibited Transporter Removal Petition is for individuals who have been found to be a prohibited transporter of firearms and are now seeking to have that designation removed. The petition must include the petitioner’s name, address, date of birth, social security number, the name of the court in which the petition is being filed, a statement by the petitioner that he or she has not been convicted of a felony or misdemeanor involving the use or threat of violence within the last 10 years, and the petitioner’s signature. The petitioner must also provide evidence that he or she is now eligible to possess a firearm. The petition must be served upon the Commonwealth of Kentucky, the Kentucky State Police, and the county attorney of the county in which the petitioner resides. Once the petition has been filed and served, the court will hold a hearing to determine whether the petitioner is eligible to possess a firearm. If the court finds that the petitioner is eligible, it will issue an order removing the firearm prohibitions in Kentucky.
