Illinois DOMESTIC RELaTIONS-AFFIDaVIT FOR SERVICE BY Publication is a legal document filed with the court in a divorce, child custody, or other family law proceedings. The document is used to inform the court that the other party has been served notice of a pending action via publication in a newspaper or other publicly-accessible document. The affidavit is used to prove that the other party had an opportunity to be informed of the legal proceedings, even if they have not been personally served. There are two types of Illinois DOMESTIC RELaTIONS-AFFIDaVIT FOR SERVICE BY Publication: the Affidavit of Publication and the Affidavit of Posting. The Affidavit of Publication is used when the notice of the legal proceedings is published in a newspaper or other publicly-accessible document. The Affidavit of Posting is used when the notice is posted in a public place (such as on a bulletin board or in a courthouse). Both documents must be signed by the individual responsible for publishing or posting the notice.
