Description

Transfer Order

An Illinois Transfer Order is an order issued by the Illinois Circuit Court to transfer a case from one court to another. There are two types of Illinois Transfer Orders, namely, Transfer to Another County and Transfer to Appellate Court. A Transfer to Another County is issued when the case is to be transferred from one county court to another county court. This type of order is usually used when the defendant resides in a different county than the plaintiff. A Transfer to Appellate Court is issued when the case is to be transferred from a county court to an appellate court. This type of order is usually used when the plaintiff is appealing the decision of the lower court. Both types of Illinois Transfer Orders require the completion of the necessary paperwork and filing with the court.

FAQ

22.1. In order to conserve judicial resources and promote efficiency in the administration of the Circuit Court, upon motion of any party or upon the court's own motion, the Circuit Court may assign or reassign related cases to a single judge wherever it serves the convenience of interested parties and the court.

If any motion is not called for hearing within 90 days, and in criminal cases within 30 days, from the date of filing, the court may set the motion for hearing and, upon hearing, may enter an order overruling or denying the motion by reason of the delay.

A person filing to service a body attachment must present two certified copies of the order, a Warrant Unit information sheet, and pay $60. Criminal Body Attachments are issued from the State's Attorney's Office (28 N. Clark) and often originate from failure to pay court ordered child support.

CASE MANAGEMENT ORDER ? CATEGORY 2 CASES The intent of this order is for the parties to complete all discovery and for the court to rule on all dispositive motions within 26 months following the filing of the complaint. This order does not alter the application of Illinois Supreme Court Rule 218 ? the 60-day rule.

This is done by a certain filing in the new county, attaching a certified copy of the original judgment to the pleading and paying a new case fee. A new case number from the new county is then assigned. However, there are certain rules as to whether further proceedings can be held in the new county.
