Hawaii Waiver from Credit Counseling and Debtor Education (Motion) is a legal document that allows a debtor who is filing for bankruptcy in the state of Hawaii to waive the credit counseling and debtor education requirements of the bankruptcy code. The waiver is usually granted when the debtor cannot complete the required courses because of financial hardship or other extenuating circumstances. There are two types of waivers available: the Hawaii waiver from credit counseling and the Hawaii waiver from debtor education. Both waivers must be approved by the bankruptcy court before the debtor can proceed with the bankruptcy filing. Both waivers require the debtor to submit documentation that shows the reason why they are unable to complete the courses. The debtor must also provide evidence of their financial hardship and any other extenuating circumstances that may have prevented them from taking the courses.
