California Transfer Tax Affidavit (San Francisco) is an affidavit used by the San Francisco City and County Assessor-Recorder to document the transfer of real estate. It is used to calculate and collect the transfer tax imposed on transfers of real estate within the City and County of San Francisco. The affidavit must be submitted to the Assessor-Recorder's office along with the deed to the property. There are two types of Transfer Tax Affidavit for San Francisco: Form TR-1 and Form TR-2. Form TR-1 is used for transfers of real estate that have been held in the same ownership for 40 years or more, or transfers between related parties. Form TR-2 is used for all other transfers of real estate within San Francisco. Both forms require the disclosure of the transferor and transferee’s name, address, and relationship; a description of the property being transferred; a statement of the consideration paid for the transfer; and a signature of an authorized representative of the transferor. The affidavit must be notarized in order to be accepted.
