The California 3 Day Perform or Quit Notice is a legal document that landlords in California used to inform tenants that they are in breach of their lease agreement and must either cure the breach or vacate the property within three days. This type of notice is required under California Civil Code Section 1161(2) and applies in situations where tenants have failed to pay rent, breached the rules of the lease agreement, violated local zoning laws, or committed any other act that violates their rental agreement. There are two types of California 3 Day Perform or Quit Notice: the 3-Day Notice to Pay Rent or Quit and the 3-Day Notice to Perform Covenants or Quit. The 3-Day Notice to Pay Rent or Quit is used when a tenant has failed to pay their rent, and the 3-Day Notice to Perform Covenants or Quit is used when a tenant has violated their rental agreement in any other way. Both notices must be served upon the tenant in order to be legally valid.
