California Request to Renew Gun Violence Restraining Order is a legal request for a renewal of a Gun Violence Restraining Order (GYRO) issued by a court in California. This request can be made by either the petitioner or the respondent of a GYRO. There are two types of California Request to Renew Gun Violence Restraining Order: 1) Ex Parte Request to Renew Gun Violence Restraining Order; and 2) Request After Notice to Renew Gun Violence Restraining Order. An Ex Parte Request to Renew Gun Violence Restraining Order is filed without the respondent’s knowledge and is used when there is an immediate danger to the petitioner. This type of request is heard in court quickly and the court may extend the GYRO for up to one year. A Request After Notice to Renew Gun Violence Restraining Order is filed with the respondent’s knowledge and must be served to the respondent. This type of request is heard in court after the respondent has been served and the court may extend the GYRO for up to 5 years. In either case, a California Request to Renew Gun Violence Restraining Order must be filed in the court where the original GYRO was issued. The petitioner must provide evidence of danger and that the respondent poses a threat to the petitioner or the public. If the court finds sufficient evidence, the GYRO will be renewed.
