The Alabama Request for Hearing (Elder Abuse Protection and Enforcement Act) is a process in which an elderly individual or their family members can request a hearing to address allegations of abuse, neglect, exploitation, or abandonment of an elderly individual. The individual or family members can make a request to the Alabama Department of Human Resources for a hearing, which will be held by an Administrative Law Judge. The main types of Alabama Request for Hearing are: Protective Services Request for Hearing, Guardianship Request for Hearing, Conservatorship Request for Hearing, and Adult Protective Services Request for Hearing. Protective Services Request for Hearing applies when a petition is filed alleging that an elderly individual is being abused, neglected, exploited, or abandoned and requesting court-ordered protection or services. Guardianship Request for Hearing applies when an individual or agency petitions the court for guardianship of an elderly individual. Conservatorship Request for Hearing applies when an individual or agency petitions the court for conservatorship of an elderly individual. Adult Protective Services Request for Hearing applies when a petition is filed by the Alabama Department of Human Resources, alleging that an elderly individual is in need of protective services.
