Procedure for Session Trial A trial is initiated by the prosecution who tries to prove the guilt of the accused through evidence. Section 225 of the Code lays down that the case of prosecution shall be conducted by a Public Prosecutor where the trial is before a Court of Session.
(1) The charge shall be read and explained to the accused, and he shall be asked whether he is guilty or has any defence to make. (2)- If the accused pleads guilty, the Court shall record the plea, and may in its discretion convict him thereon.
Provided that no such charge shall be read out by the Judge nor shall the accused be asked to plead thereto nor shall the previous conviction be referred to by the prosecution or in any evidence adduced by it, unless and until the accused has been convicted under section 229 or section 235.
